Order Approval & Fabrication
By submitting payment, placing an order, and approving the final drawing, you authorize DaVinci Gate to fabricate your gate or panel according to the specifications outlined in the approved drawing and this invoice. Once fabrication begins, the order is considered final and cannot be modified. All fabrication is based on the customer’s specific requests and approved design. DaVinci Gate does not guarantee performance, fit, or functionality beyond the scope of fabrication as specified.
Add-On Invoices
Invoices for add-ons (e.g., color, size, accessories) are subject to the same approval and finality terms as full orders. By submitting payment, you authorize DaVinci Gate to proceed with the specified change(s). Add-ons are non-refundable and may affect lead time.
Modification Requests on Existing Products
DaVinci Gate does not offer repair services. In limited cases and solely at our discretion, we may agree to perform modifications on a previously purchased DaVinci Gate product. All modification services are considered custom work and are subject to separate written approval and invoicing. Modification services are non-refundable, final, and not warrantied. DaVinci Gate does not guarantee performance, fit, or functionality after modification, especially when the request is due to customer measurement errors, installation issues, or changes in project requirements. Customers are responsible for all shipping costs associated with sending the product to and from our facility. DaVinci Gate reserves the right to decline any modification request for any reason, including structural concerns or incompatibility with the original design.
Intellectual Property & Design Usage
DaVinci Gate retains intellectual property rights to all original designs, drawings, and custom artwork created during the fabrication process. These materials may not be reproduced, distributed, or used for derivative works without written permission.
Customer-provided designs remain the property of the customer. However, by submitting a design for fabrication, the customer grants DaVinci Gate a non-exclusive, royalty-free license to reproduce the design for future products. This license allows DaVinci Gate to fabricate gates using the same or similar design for other customers, unless exclusivity is requested in writing prior to fabrication. DaVinci Gate will not associate reused designs with the original customer’s name, property, or context.
Custom Order Policy
All DaVinci Gate products are custom fabricated. As such:
No cancellations, refunds, returns, or exchanges will be accepted once fabrication has commenced. All sales are final. Please review your order carefully before approval.
Order Refusal & Cancellation
DaVinci Gate reserves the right to refuse or cancel any order at our discretion. This may include, but is not limited to, cases involving prior disputes, non-compliance with our policies, or any circumstances that may compromise the integrity of our process or customer relationship.
Return Exception Clause
While all sales are final, in rare cases where a return is accepted at DaVinci Gate’s discretion, the refund will apply only to the cost of the item. Original shipping fees are non-refundable, and return shipping is the customer’s responsibility.
Free shipping and percentage-based discounts are offered on select orders at DaVinci Gate’s discretion. These promotional credits are applied at the time of purchase and are nonrefundable under all circumstances. If a customer refuses delivery to the address provided on the original order, or returns the item for any reason, DaVinci Gate reserves the right to deduct the actual shipping costs from the total payment received. These shipping costs are nonrefundable and will be subtracted from any eligible refund or credit, if applicable.

Stock & Sale Items
All stock items, discounted products, and sale items are considered final sale. These items are non-refundable and cannot be returned or exchanged under any circumstances.
Installation Disclaimer
DaVinci Gate is a fabrication-only provider. Installation is not included and is not offered as part of our services. We are not responsible for errors made by third-party installers, including incorrect orientation, mounting, or hardware usage. Customers and their installers must review all drawings and specifications prior to installation. We strongly recommend confirming hinge placement, swing direction, and lock box orientation before proceeding.
Installer Responsibility
All installation decisions—including orientation, anchoring method, and hardware selection—are the sole responsibility of the customer or their installer. DaVinci Gate does not provide installation guidance or supervision. Any issues arising from improper installation do not qualify for refund, return, or modification.
Structural Suitability & Installation Responsibility
Due to the custom nature and potential weight of our fabricated gates, it is the customer’s sole responsibility to ensure that the installation site (including walls, posts, and mounting surfaces) is structurally suitable to support the gate and all related hardware. DaVinci Gate does not assess or guarantee compatibility with any specific installation environment. We are not responsible for issues arising from improper installation, insufficient structural support, or failure to secure the gate safely. We strongly recommend consulting with a qualified installer or contractor to ensure proper anchoring and functionality.
Limitation of Liability
DaVinci Gate is not liable for any indirect, incidental, or consequential damages resulting from the use, installation, or performance of our products. This includes, but is not limited to, damage to property, loss of use, or personal injury. Our responsibility is limited solely to the fabrication of the product as specified in the approved drawing and invoice.
Warranty Disclaimer
DaVinci Gate does not offer a product warranty. Durability and performance may vary based on factors outside our control, including installation conditions, environmental exposure, and maintenance practices. We encourage customers to follow care and usage guidelines to help extend the life of their product. No guarantees are made beyond the scope of fabrication as outlined in the approved drawing and invoice.
Measurement Tolerance
All measurements, including those in the approved drawing, are subject to a fabrication tolerance of ±1/8 inch. Minor variations within this range are considered acceptable and do not qualify as defects.
Fabrication Standards & Visual Variation
All DaVinci Gate products are handcrafted using CNC plasma cutting. This process may result in minor visual variations, including entry points at internal cutouts and slight texture along cut lines. These features are inherent to plasma cutting and are not considered defects. Product photos reflect typical outcomes and may vary slightly from final fabrication.
Fabrication Lead Time
Fabrication and handling typically require 25–30 business days from the date of approval and payment. This estimate may vary based on workload, material availability, and production conditions.
We kindly ask that all address changes be submitted via email and confirmed in writing. Verbal or unconfirmed requests may not be honored.
Force Majeure
DaVinci Gate is not responsible for delays or failure to fulfill obligations due to events beyond our control, including but not limited to natural disasters, labor shortages, supply chain disruptions, transportation delays, or acts of government. In such cases, timelines may be adjusted without penalty or liability.
Delivery & Damage Inspection
A signature is required upon delivery. Customers must inspect the packaging and product at the time of delivery or pickup. In the rare event of visible damage to the packaging or product:
Note the damage clearly on the delivery receipt before signing
Photograph the packaging and product immediately
Do not discard the packaging — it must be retained for documentation and potential claims
Report the issue to DaVinci Gate via email within 24 hours
DaVinci Gate is not responsible for any damage or claims made after the product has been signed for and released without proper documentation.
Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of the State of California. Any disputes arising from these terms shall be resolved in the appropriate courts located within San Diego County, California.
